Henderson County Residential Property Values At Stake With Party Barn Permit

Dear friends,

Thank you so much for the huge turnout at the Commissioners meeting of May 1st.  We filled the room completely and 30 people spoke at the microphone - all opposed to the event barn.

Now HUGE NEWS.  On June 28 at 4pm there will be a hearing of the Zoning Board of Adjustments to consider revoking the permit.  This is a direct result of all of our efforts.  The ZBA usually meets in the planning building on King St but I suppose if they expect a large crowd they might move it.

 

Please make every effort to be there.  I am sorry to ask so much of you but, one never knows, but I think this is the big one.  Arrive early if you want to sign up to speak.  In this hearing they will determine if you have "standing" to speak, so sign up but they might not give you standing.  They will likely give standing to anyone who lives within a certain distance of the barn.  They might also give standing to any of the 76 people who signed the letter requesting revocation.  Even if you are just part of a big crowd, that will carry weight.

 

It is a little unclear what they will allow us to talk about.  They might limit certain topics.  If you are considering speaking at this hearing, email me and I will try to put together a summary of what they might or might not let us talk about.  I have retained an Asheville attorney who was the Attorney for the City of Asheville for 17 years and who is one of the few experts in zoning and local government issues.  I will speak to him Monday to get more guidance.

 

If you have heard that that hearing is only for clarifying 5 questions about the permit, that is old news.  Now the hearing is about revoking the permit.

 

The current print edition of Hendersonville Lightning has an incredibly one sided and unfair article about the event barn.  It is likely that within a few days it will be put on their website.  If this happens please use there comments section to set the record straight.  The article is based on Bill Moss's interview with the Cranes, the ones building the event barn, with absolutely no reporting of the other side of the story.  Nothing about zoning, noise, property value...a truly amazingly bad piece of journalism.  One example: some of you who do not live in our neighborhood spoke at the Commissioners meeting about concerns that residential zoning might mean nothing.  This article implies that you had no business speaking at that meeting.  The entire article is full of unverified quotes and innuendos.

Dear Friend, Neighbor and Opponent of the Event Barn (party barn): 
 
 This is an update on the Party Barn Permit: Regardless of where you live in Henderson County, all of our property values are at stake if the party barn on 191 is allowed to go forward.  Residential zoning will mean nothing. This opens the door for any commercial enterprise will be permitted in residential areas.  (See original post here.)
 

Our project is evolving but we are moving forward toward our goal of revoking the Special Use Permit that allows this facility to operate.

 
We have been given legal counsel that tells us the Commissioners cannot revoke the permit.  For this reason we are no longer asking to be put on the agenda for the May 17th Commissioners meeting.  None the less, it is important for the county commissioners to hear the community's concerns about the the event barn.  Therefore, please be sure to attend the Monday, May 1st 5:30pm Commissioners meeting at the Old Courthouse on Main Street.  We suggest that you be there by 5pm to sign up to speak for up to 3 minutes.  Comments can be brief:  “I am here to express my opposition to the Event Barn.”  Our impact will be greater if many people speak.

 This issue effects all property values in Henderson County !  If this permit is not revoked, no neighborhood in Henderson County is safe from commercial building.  Zoned residential will come to mean nothing! 

 
Though I realize the  authority to revoke the special use permit rests with the County Zoning Administrator, I am here to express my commitment to have this permit revoked and to alert my neighbors of this serious issue that will come to affect Henderson County our property values.   Thank you. 
 
 
The next document attached addresses the revocation request.  Please consider signing it even if you have already signed the petition.  The petitions will be submitted to the Commissioners to demonstrate the extent of our interest and commitment to its resolution.
 
After Monday's meeting there could be a revocation hearing and a Zoning Board of Adjustments appeal.  Please try to attend those should they come to pass.
